Terms of Service
These Terms set out the rules for using the Liv&Now website, buying catalogue products, placing custom orders, and submitting artwork or account information. Domestic India and cross-border transactions are handled separately because their risk profile, tax treatment, and consumer rights differ.
Domestic Pathway
For customers located in India and transactions primarily governed by Indian law.
Who we are and how to reach us
These Terms govern access to the Liv&Now website, customer accounts, product purchases, and custom-order workflows for customers in India. The seller is Liv&Now Clothing, operated from Tiruppur, Tamil Nadu, India. For order disputes, billing issues, or general complaints: hello@livnow.in. We aim to respond within 48 hours on business days.
These Terms are drafted with reference to the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000, and Indian contract law. Read them together with our Privacy Policy, Shipping Policy, and Returns & Exchanges Policy.
Contract formation
A binding contract is formed when Liv&Now accepts your order and issues an order confirmation. Displaying a product on the website is an invitation to treat, not an offer. We reserve the right to decline or cancel an order before dispatch if the item is out of stock, there is a pricing error, or the order cannot be fulfilled for any lawful reason.
For custom orders, the binding contract is formed when you approve the production quote and complete payment. The approved quote, artwork confirmation, and size breakdown form part of the contract.
Platform use and user responsibilities
- You must be at least 18 years old or have parental consent to create an account or make purchases.
- You must provide accurate name, address, phone, email, and payment information.
- You must not upload unlawful, infringing, defamatory, harmful, misleading, or unauthorised content including in custom-order design flows.
- Where you submit logos, artwork, slogans, photographs, or other creative assets for custom orders, you represent that you have the legal right to use, reproduce, modify, print, and commercialise that content.
- You must not use automated tools, bots, or scripts to scrape, monitor, or interact with the website without permission.
Pricing, availability, and payment
All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise at checkout. Shipping fees, customisation charges, and quote-based charges may be added at checkout or in a custom-order proposal.
We may correct pricing errors or stock inaccuracies before dispatch. If an accepted order cannot be fulfilled on the stated terms, you will be informed and offered a refund, cancellation, or revised offer. Payment is processed by Razorpay; Razorpay's terms govern the payment transaction.
Custom orders, approvals, and cancellations
Custom orders require a separate quote, design approval, and payment before production begins. Quotes remain subject to fabric availability, production feasibility, print clarity, and payment clearance. Once you approve a mockup, size breakdown, fabric choice, or production proof, you are responsible for checking all details including spelling, dimensions, colour expectations, placement, and IP rights.
- Cancellation before quote approval: full refund of any deposit paid.
- Cancellation after quote approval but before production starts: refund minus any sourcing or material costs already incurred.
- Cancellation after production has started (cutting, printing, embroidery, or sewing): no refund, as the goods are made to your specification.
- Minor colour, scale, or placement variation may occur due to screen rendering, dye lot variation, wash process, print technique, or fabric characteristics and does not constitute a defect.
Intellectual property
All site design, branding, photographs, copy, product presentation, and original Liv&Now creative assets are the property of Liv&Now Clothing or its licensors. You may not reuse or commercially exploit them without written permission.
If we reasonably believe submitted content may infringe third-party rights, violate law, or expose the business to risk, we may suspend processing, request supporting rights documentation, remove the content, or cancel the affected order without liability.
Liability and consumer rights
Nothing in these Terms limits non-excludable rights available to Indian consumers under applicable law, including statutory remedies for defective goods, unfair trade practices, or failed services under the Consumer Protection Act, 2019.
To the extent permitted by law, Liv&Now is not liable for indirect, consequential, special, or incidental loss — including lost profits or brand-use loss — arising from customer-supplied design errors, incorrect delivery addresses, third-party payment failures, or events outside our reasonable control.
Complaints may be raised at hello@livnow.in. If not resolved within 30 days, you may approach the District Consumer Disputes Redressal Commission with jurisdiction over Tiruppur, Tamil Nadu.
Governing law
These Terms are governed by the laws of India. Any dispute that cannot be resolved through our support channels will be subject to the jurisdiction of courts in Tiruppur, Tamil Nadu, without prejudice to your rights to approach any consumer forum as permitted by Indian law.
International Pathway
For customers outside India, cross-border deliveries, and additional foreign-market considerations.
Cross-border sales
For customers outside India, orders are accepted subject to destination-country serviceability, export controls, sanctions screening, and shipping partner acceptance. We may decline or cancel an order where cross-border shipment would create legal or operational risk.
You are responsible for confirming whether the ordered goods can legally be imported, and whether local product restrictions, labelling standards, textile rules, or resale restrictions apply in your destination country.
Customs, taxes, and import compliance
- International prices exclude import duty, VAT, GST, sales tax, customs clearance fees, and brokerage charges unless checkout explicitly states duties are prepaid.
- The recipient is responsible for customs declarations accuracy (where customer-supplied data is used) and for paying destination-country taxes or import charges, unless Liv&Now has expressly agreed to deliver duty paid.
- If a parcel is refused because duties are unpaid or import formalities are incomplete, we may deduct the courier return cost, customs penalties, and non-recoverable production costs from any refund where law permits.
International consumer rights
Mandatory consumer-protection rights in your country may override conflicting contract language. If destination-country law gives you non-waivable rights, those rights continue to apply to the minimum extent required by that law.
For EEA, UK, or similarly regulated markets, pre-contract disclosures and data handling should be interpreted consistently with applicable mandatory consumer and privacy rules.
International custom orders
Cross-border custom orders may require more detailed approval, proofing, compliance review, and payment verification than standard catalogue items. Unless required by mandatory local law or explicitly agreed in writing, custom-manufactured orders are final once production begins.
Governing law — international
These Terms are anchored in Indian law and managed operationally from India. This does not remove mandatory protections available to consumers under the law of their habitual residence where such protections cannot legally be excluded by contract.
